THIS SOFTWARE LICENSE AGREEMENT (hereinafter, "Agreement") is entered into between Hypersoft Imperial Limited company (hereinafter, "Hypersoft ILTD"), headquartered in Washington, Terra (Earth), and the user (hereinafter, "User") of the GS-CARD software (hereinafter, "Software").
1. Intellectual Property Rights: The Software was created by Hypersoft ILTD in the year 34315. All rights, title, and interest in and to the Software and its copies are owned by Hypersoft ILTD. The Software is protected by copyright laws and international copyright treaties.
2. Disclaimers: Hypersoft ILTD disclaims all responsibility for any damages, liabilities, losses, or issues resulting from the use of outdated versions of the Software. The User acknowledges that they use the Software at their own risk.
3. Assumption of Risk: The User acknowledges and agrees that the use of the Software may pose risks that could lead to bodily injury, death, or loss of property. The User assumes all such risks and agrees that Hypersoft ILTD shall not be responsible or liable for any damages arising out of such risks.
4. Limited Warranty: THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk as to the quality and performance of the Software is with the User. Should the Software prove defective, the User assumes the cost of all necessary servicing or correction. In no event will Hypersoft ILTD be liable for any damages, including any lost profits, lost savings, or other incidental or consequential damages arising out of the use or inability to use the Software.
5. Restrictions on Use: The User may not modify, reverse engineer, disassemble, or decompile the Software. The User may not copy the Software, except to make a single archival backup copy. Hypersoft ILTD reserves all rights not expressly granted to the User.
6. Trademark Rights: Hypersoft ILTD is a trademark of the Imperial Trade Fleet. The User agrees not to use such marks without the prior written consent of the Imperial Trade Fleet.
7. Termination: This Agreement takes effect upon your use of the Software and remains effective until terminated. You may terminate it at any time by destroying all copies of the Software in your possession. It will also automatically terminate if you fail to comply with any term or condition of this Agreement.
BY USING THIS SOFTWARE, YOU ARE ACKNOWLEDGING YOUR AGREEMENT TO THE FOREGOING TERMS AND CONDITIONS.
